Ask a Lawyer: Military retirement and disability Separate Property

Question:

My father is 73, retired USAF with 40% disability pay. He is getting divorced. His wife was not with him while he was on active duty. All children are grown and out of the house. He has been the primary bread winner, but she has had a job for quite some time. During the marriage she was funneling money back to the Philippines and bought a house in her name only without telling my father. He recently discovered this. Is his retirement subject to division as marital property even though it was his when he married her? Is his disability also subject to division? Is the house she acquired with his money during the marriage subject to division? Please help? I need some direction for him as he goes into mediation. She also emotionally and physically abused every child but her own while they were in the house. My father was not very aware.

Answer:

I am not licensed in South Carolina. Every state will have different laws concerning property division so you should also consult an attorney your state. Most states include all assets in the marital pot, including retirement earned prior to marriage. However, the court will likely set that aside to your father since it was earned prior to the marriage. As for the house in the Philippines, it should be included as an asset. It may be difficult to value since it is out of country. Its value should however be considered when dividing the marital pot.

Question:

How have you or all the Father's across the country dealt with a Pathological Lying ex? She has 5 children by 4 men. She has had 4 abortions; 1 forced by parents and the other 3 were used as birth control. She held other things back because she knew I would not marry her if truth be known. Second son came about by cheating on her first husband with a married man. Our divorce was finalized Dec. 13, 2006 and she is remarried by Aug. 14, 07. I just spent the night in jail on the night of Labor Day because of her lies. She broke the divorce decree by allowing her boyfriend to spend the night while my son was in the house on top of the other 4 children that she has. What about the rights of the children? What about my son

I have only been married for 2 months and my husband moved in my house (with just my name on it) he has lived there for 4 months. What do I need to do to get him out? I live in Wetumpka Alabama

Answer:

First, I must advise you that I am not licensed in Alabama. You should also seek the advice of an attorney licensed in Alabama as laws will vary from state to state. Since, you are legally married it may be difficult to remove your spouse from the home without a court order. It is unlikely law enforcement will remove him absent a court order regardless of whether his name is on the property. In order to obtain a court order you must file for divorce or legal separation. You should be able to request temporary possession of the home pending finalization of the divorce. Since you marriage is short and you owned the home prior to the marriage it is likely that you will get temporary and permanent possession.

Question:

I would like to know how many days children of 15 years through 18 years can be left alone without a parent present. What are the general rules that apply when two divorced parents split custody, but when one parent is leaving minor children unsupervised? Does this fit into a right of first refusal? What is the procedure for my documenting this and calling it to the court's attention?
