Houston Divorce LawyerQuestion:

We share joint physical custody almost 50/50, but my ex is listed as the primary custodial parent simply because she works from home.

Because she is listed as the primary parent, I am obligated to pay child support yet the child support calculations did not account for her salary. Is this correct?

Also, if we are splitting parenting time why is it that I am obligated to pay child support simply because of a technicality that we had to list one parent as "primary"?

My child support questions is regarding my new new job that will require me to miss periods of parenting time with my children over the coming year.

My ex-wife says that she can modify my child support to increase my child support since she will have more parenting time.

Am I required to pay any additional money if I do not see my kids on the weekend that I am scheduled?

Also, I would like to modify my divorce order so that we split transportation so that I do not have to both drop off and pick up the kids during every visitation. Is that possible?

My ex-wife has primary child custody and she told me she is going to take our child and move out of state next week.

She told me since she is the custodial parent and I have limited visitation rights that there is nothing I can do about it.

Can she move my child out of state or is she in violation of the court's child custody order?

As winter weather and resulting snow days makes dreams come true for children across the country, it raises the issue of how parenting time and child custody exchanges are handled on unexpected days off from school.

Typical child custody exchanges on normal school days usually occur after school the school day ends. But who gets the child on snow days when school is canceled on little notice?

Is it treated as a holiday and parents should follow the holiday parenting time schedule or is it just considered a normal day and the child custody exchange should take place as usual even though the kids aren't in school that day?

My wife and I are currently in a marriage separation period and she resides in the marital home, which I still pay the mortgage on.

She wants her boyfriend to come stay with her at the house on nights she has parenting time with our children, which I am completely against.

Do I have any say in who can or cannot stay at the marital home while I am still paying for it and my name is still on the mortgage?
