That debate you had before your marriage - should your wife change her last name or keep her maiden name, hyphenate it or use both - will resurface when you divorce.

If your ex-wife will not change her last name, can you force her to? The short answer is, no. But there are exceptions.

  • My wife and I were married in Canada, but she now lives     in California. Do we have to get divorced in Canada? Will I     be liable for any expenses until the divorce is final?

Ask a Lawyer: Ex-wife hyphenating surname to new husband's name

Question:

RE: Divorced - Joint custody of 6 yr old minor girl. Mom has daughter through the school yr and the Dad has daughter during summers and school breaks. Mom remarried a multimillionaire and wants to hyphenate the daughter's last name without the fathers permission. We are not even sure this marriage is going to last. The daughter's school yearbook reflects this newly hyphenated name. The mother is trying to say that not using the hyphenated name is psychologically damaging to the child (she just wants to flaunt the name to match her own last name now). The father is a wonderful man and a very good father to his daughter. What legally can he do to set things straight with the school and the stubborn mother who refuses to keep the surname?

Answer:

I am not licensed in CA and therefore cannot answer your question specifically to the laws of that State. I would suggest that you consult a local attorney about filing a Motion to Modify the legal custody or a Motion for Contempt of the Joint Legal custody arrangment. Changing the child's name is a legal custody issue that should be decided together if the parties share joint legal custody.
