advice on divorceQuestion:

My ex-wife has primary child custody and she told me she is going to take our child and move out of state next week.

She told me since she is the custodial parent and I have limited visitation rights that there is nothing I can do about it.

Can she move my child out of state or is she in violation of the court's child custody order?

divorce lawyer Daniel LambertQuestion:

I need information on what state has jurisdiction for my child support modification.

My ex-wife and kids moved to the state I previously moved to (Wisconsin) after our divorce was finalized in Illinois. Our divorce decree states my child support payments are contingent upon my ex-wife selling the marital home. Well, she just left the home, let it go into foreclosure, and recently bought a home in Wisconsin; these actions should allow me to modify my support.

Will I have to file for the child support modification in Illinois, where the divorce was finalized and where the marital home was located, or can I file in Wisconsin where all the parties now live?

advice on divorceQuestion:

I am looking for an alimony and child custody modification but am unsure which state has jurisdiction to proceed.

I currently live in another state from where our divorced was filed. My ex-wife and children continue to live in that state.

Could I get a change of venue so that the state I live in would have jurisdiction to handle my child custody and alimony modification procedures or do I have to go through the courts in the state where we got divorced?

New Jersey divorce lawyerQuestion:

I have two marriage separation advice questions concerning child custody and child support when my children live in another state.

Since my ex-wife and children moved out of state, which state do I pay child support in?

Also, how does joint custody work if the parents do not live near each other?

divorce lawyer Daniel ExnerQuestion:

Per our child custody agreement, I have parenting time with my children the majority of the nights each week.

My ex-wife has full visitation rights. I am looking to move with my children to another state to be closer to family. Even though we have joint custody, my house is considered the children's primary residence.

Can I just inform her that I am moving out of state and leave or will a judge block me from moving?
