Question:

I pay alimony to my ex-wife. Our divorce decree is silent on the issue, but it is my understanding that I should no longer have to pay alimony if she is remarried or cohabiting.

My ex-wife is engaged, but I'm still paying her spousal support. It seems totally unreasonable to have to continue to pay alimony to an ex-spouse after she remarries.

So how can I get my alimony payments stopped after my ex-spouse remarries if the divorce agreement is silent on the matter of her cohabiting or remarrying?

I am trying to modify my payments of child support arrears.

I do owe the money and intend to pay it back, but the amount being garnished is too high for me to survive on.

When trying to modify the child support amount, the child support enforcement unit said I am unable to modify the amount because my child is an adult and considered emancipated.

Is this true? How can I lower my monthly child support arrears obligation?

Question:

My divorce question is about claiming children for taxes when owing child support arrears.

Per my divorce decree, I am to claim our youngest daughter every year for taxes. Last year, she claimed our daughter stating she had the right to do so because I was in arrears with my child support, and she said she is planning on doing the same this year.

I warned her that what she is doing is in violation of our decree and probably tax fraud. Can she really do this if I owe back child support?

How is child support calculated when the custodial parent receives a large share of marital property?

My ex received half of my retirement account in cash and is spending like crazy. With the income from her job and the money she took from my retirement, she made significantly more than I did last year.

Can I temporarily modify child support because of this even though the property division payout was a one-time payment?

Question:

Per my divorce decree, I am responsible for paying child support and my children's health insurance. 

I can no longer afford to enroll my children in health insurance offered through my work and would like to enroll them in a program offered by the state. However, my state requires the custodial parent (my ex-wife) to enroll the children, and she is refusing to do so.

Can I take her to court to force her to enroll our kids in the state program or will I be forced to carry them on my employer's health insurance that I cannot afford? Will my child support be modified?
