Ask A Divorce Lawyer: What kind of proof is required for disclosure of income?

Question:

In spousal support cases, what rule(s) compel the party being paid spousal support to provide proof of any income or lack of income? Does this proof include things such as unemployment or denial letters from unemployment office, state disability checks or denial letter from state disability, worker's compensation awards, etc. Although check stubs/tax statements and receipts were asked for, the court did not compel the other party to provide “evidence” nor did it sanction them for not providing them. The court simply ignored the request.

Question: Does the mother's income ever play a role in how support, maintenance or medical bills are handled? 

When the mother's income is exponentially larger than the father's is this ever considered?

Question: 

Is it legal for my ex to receive the income from her two older sons (both over 18) whom reside with her, and not disclose that to the court for child support judgment?

Ask a Divorce Lawyer: Can my ex sue for back child support if she found out I lied about my income?

Question: My husband was not married to his daughter’s mother. Their child is now 20 years old, and he has always paid his child support. 

In 2008, after the daughter was 18, my husband’s ex filed a complaint with the court that he did not pay what should have been paid claiming that he lied about his income. She knew how much he made because they did a refinance of his home in 2005. 

My husband’s appeal dates have past and it seems that the judges don't care about him and what he has done for his child. Now it seems like my husband may lose his entire 401(k) because the mother feels she can get away with lies and because she knows the court system because she was a paralegal. 

Can you tell us what to do?

Ask a Divorce Lawyer: Is income of the parties a factor in deciding who gets custody?

Question: I live in Missouri and am going to get a divorce. I was wondering what is the biggest factor in who will get the kids? 

My wife makes a lot more money, but I’m the one who takes care of them most of the time, drop off and pick up from daycare, make the dinner, bathe them, etc. 

Will any of that pay a factor or will the courts simply side with the rich mom who can buy them nicer things, a bigger house, and better schools? Sounds cheesy, but do the courts ever take love of the children into the decision, which would greatly slant my way?
