parental alienationBy Daniel Exner

Milwaukee Divorce Lawyer

Dads seeking divorce advice frequently ask divorce lawyers about how to keep their ex-wives or soon-to-be-exes from saying negative things to the children about their father.

Many divorced parents will talk about the divorce case with their children, use the kids as messengers, or, in worse cases, fill their children's heads with lies about the other spouse in an attempt to turn the children against the targeted parent.

While there are legal steps you can take to prevent your children from being exposed to the details of your case, practically speaking, these options may not produce the best results.

facebook divorceBy Jill Coil

Utah Divorce Lawyer

You’ll often hear about Facebook and other social networking websites being a foe in your divorce and child custody case, but there are times when these social outlets can also be your friend.

We all have mistakes and regrets in our past that we wish to forget and delete from memory. Before Facebook, these missteps would only be remembered by a small circle of people and they were rarely documented for the public.

But social networking websites allow our transgressions – including those of our spouses - to become public knowledge that can be used in court.

Mens divorce lawyerQuestion:

Do child custody laws do anything to prevent parents from bringing dangerous people around their children?

My ex and I split child custody, but she has a boyfriend who drinks a lot and even does drugs. I have no proof this is done in front of my children, but I know she brings him around my kids.

Can I keep her boyfriend from being around our kids during her parenting time?

St. Louis divorce lawyerQuestion:

What type of evidence is considered for child custody determinations?

The mother of my child is bipolar and subject to extreme mood swings. She also is very free with her sexuality, including sending me videos of her having sex with other men. I'm worried for my child's welfare and want to get custody.

Is any of her mental and sexual issues relevant in a child custody hearing?

mediation divorce questionsBy Daniel L. Lambert

Mens Divorce Attorney, Cordell & Cordell

Typically in a divorce and child custody case where the parties cannot agree to a parenting time schedule or to child custody agreements, then the parties are sent to mediation.

The mediator does not represent either party and cannot provide legal advice on divorce. The mediator may provide an explanation of the legal system and the law, but is prohibited from providing actual legal advice.

The assigned mediator may or may not be an attorney. The mediator is appointed by the court to help the parties reach a mutual agreement on placement and custody.

It is important to understand that different mediators use different tactics to encourage the parties to reach an agreement.
