Child dependency exemptions can equal some major cash over a few years.

In order to be qualified to claim a child dependency exemption the child must be your child (birth or adoption; care of other family members may qualify for an exemption as well), under age 19, lived with you for more than half the year and the child must not have provided more than half of their own support.

Essentially, this rule allows the primary custodian to claim a dependency exemption for a child.

Question:

I have been divorced for a little over 5 years and live in Tennessee. I have an 8 y/o daughter thats resides with her mother in Virginia. I have been paying my child support since the divorce. I also help with school and sports expenses for her on top of my child support. My ex also has 2 other children. I recently asked if I could claim my daughter every other year on income taxes. She said no because she needs the money for them. If I filed a petition with the courts, would I file in TN or VA? Is there any law or rule that explains this?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Tennessee. You did not tell me where your original action was filed (Tennessee, Virginia or other state?). That is important. Support will always stay in the original state that the proceeding began in. Some states consider tax exemptions to be child support others do not so it may not be modifiable in those states. That is certainly something to look at before going to court since the issue of tax exemptions may be considered completely unrelated to child support and thus have no effect whatsoever on the support order, or vice-versa.
