advice on divorceQuestion:

Per our divorce decree and state child support laws, my child support payments end when our child reaches the age of 18 or when he graduates from high school, whichever occurs last.

My child has already reached 18 and has already finished his course work to complete high school, yet he doesn't actually participate in his high school graduation ceremony until this summer when the rest of his class graduates.

So should my child support terminate when he actually completes all of his course work or must I continue paying until this summer when he walks across the stage and physically is awarded his diploma?

advice on divorceQuestion:

I am trying to modify my payments of child support arrears.

I do owe the money and intend to pay it back, but the amount being garnished is too high for me to survive on.

When trying to modify the child support amount, the child support enforcement unit said I am unable to modify the amount because my child is an adult and considered emancipated.

Is this true? How can I lower my monthly child support arrears obligation?

I am not in arrears and my child just got married at age 18, but I'm scheduled to pay child support for another year.

Am I still required to pay child support to my ex-wife if my child is now married?

Proposed child support laws in Indiana would lower the age of emancipation and result in child support ending when a child reaches age 19 instead of the current age of 21.

While the proposal to knock two years off of the child support was suggested for the purpose of making Indiana potentially eligible to receive additional federal funding, the proposed legislation would also be beneficial to divorced dads ordered to pay child support during those years.

When states try to lower the age of emancipation for child support, the hope is the number of court cases regarding non-payment of child support will be reduced, the number of people found in contempt of court for non-payment of child support will be reduced, and the number of people incarcerated for failure to pay child support will be reduced.

My daughter currently resides with me full-time and is no longer attending school, yet I am still paying child support to her mother - the supposed custodial parent.

Does a child have to be enrolled in school and living with the custodial parent in order for my ex-wife to continue collecting child support?

I feel that I should no longer be paying if she is leaving with me and not in school.
