Question:

In my divorce, my ex-wife and I were to split all debts 50-50. However, she has failed to pay many of the utility bills and now those companies are coming after me for full payment because she is not working.

Can I just show them the divorce court order that I am only responsible for half the debt and that they need to go through my ex-wife for the other half? Or will these companies hold me fully responsible for these debts?

Question:

My ex-husband and I filed a joint tax return in 2010 while still married and we owed a lot of money. We divorced in 2011.

How would we handle the 2010 tax expense debt if it was not addressed in the divorce decree? My ex-husband says I owe him half the debt but I cannot afford it.

Question:

My wife has a gambling addiction that has put us severely in debt, with the majority of the debt being in her name.

Will I be liable for her gambling debts in the divorce?

Unfortunately, the majority of people begin to consider asset protection planning only after being served with a lawsuit, but by then, it is already too late to shield your assets. 

Generally, unless you have an Antenuptial Agreement (or "prenup") property, debts, and financial assets acquired during the marriage are considered marital property and will be equitably divided during the divorce.

Question:

My wife racked up excessive credit card debt before we married and is now trying to make me pay off those cards that are in her name only as part of our divorce settlement.

My name is not on those credit cards, and I have no direct line of credit.

Will a judge make me pay for credit card debt that is in my wife's name only and the majority of which was accumulated before we married?
