divorce lawyer Daniel ExnerQuestion:

Per our child custody agreement, I have parenting time with my children the majority of the nights each week.

My ex-wife has full visitation rights. I am looking to move with my children to another state to be closer to family. Even though we have joint custody, my house is considered the children's primary residence.

Can I just inform her that I am moving out of state and leave or will a judge block me from moving?

Per my temporary child custody agreement, my 10-year-old daughter is supposed to spend weekends with me for my parenting time while our divorce is ongoing.

Lately, she has been refusing visitation for the whole weekend and only comes over for one night because I run a stricter household with more rules.

I told her until her behavior improves and she apologizes to me that she will not be coming over to my house during my parenting time.

I want to know if this will hurt my child custody case if she is refusing to exercise her full visitation time with me and I have told her she can't come over until she apologizes?

I need to know how to prepare myself for a potential child custody battle. The mother of my child is very promiscuous and often engages in sexual acts while our small child is in the same room.

Apparently this is not illegal, but she continues to behave this way even after I've expressed to her that I think it's highly inappropriate for our child to be anywhere near that.

Is this something that I should be documenting or record our conversations about the subject in case I need it for a possible custody battle?

In my divorce and child custody case, my wife wants to have our children testify in court.

I don't want to put them in the middle of a child custody battle where they feel like they will be betraying one parent. They're just kids and don't need that type of emotional pressure.

Can I object to my minor children being forced to testify in a child custody case?

Many of the proposals gained more coverage, more sponsors, and wider support than ever before. However, history shows us that while "radical" reform proposals energize activists, they are not likely to ever see a governor’s pen.

With the arrival of summer recesses, it may be time for activists to reflect: what reforms are within reach and how might they be achieved?
