On the international stage, the British and the Americans often like to present a united front. Our countries share many similarities. DadsDivorce.com is even visited by more people in England and Wales than any other country outside of the United States.

However, that does not mean that we have the same laws when it comes to divorce. The law in the U.S. is further complicated by the fact that it can vary from state to state.

As an English attorney focusing on divorce law, I am very familiar with the way the law deals with children when a relationship ends in England and Wales.

But if I compare the laws of England to, say, the state of Florida, we will find some of the similarities and differences between the two systems.

Question:

The mother met a man on the Internet from England and says she is going to take the child there for a two week visit but has told a friend she is not coming back. Neither parent has custody. The child resides in the mother's home and the father pays support and the child does spend some nights with him. The paternal grandmother has the child most of the time. Can one parent move out of country with the child without the knowledge and/or consent of the other parent.

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Pennsylvania. I am concerned that you say neither one of you have custody. Are you the Father through the eyes of the Court in a Judgment or just know you are? Normally one parent can not take a child out of the country without waivers signed by both parents. If you are not the father under the law then she may be taking advangtage of that. You may need to file a Paternity Petition to establish being the father, and an Emergency Motion to stop her from leaving or at least staying there.
