advice on divorceQuestion:

I am trying to modify my payments of child support arrears.

I do owe the money and intend to pay it back, but the amount being garnished is too high for me to survive on.

When trying to modify the child support amount, the child support enforcement unit said I am unable to modify the amount because my child is an adult and considered emancipated.

Is this true? How can I lower my monthly child support arrears obligation?

St. Louis divorce lawyerQuestion:

My wife, whom I am separated from, is about to receive a substantial lump sum payment of child support arrears owed by her ex-husband.

Since I supported her and my stepchildren all those years when she was not receiving her child support, am I entitled to any of this back child support money she is receiving?

divorce lawyer Daniel LambertQuestion:

I pay child support and would like to know the child support laws concerning paying support to a child who is married.

I am not in arrears and my child just got married at age 18, but I'm scheduled to pay child support for another year.

Am I still required to pay child support to my ex-wife if my child is now married?

child supportBy Sara Pitcher

Noblesville, Indiana Divorce Lawyer

Proposed child support laws in Indiana would lower the age of emancipation and result in child support ending when a child reaches age 19 instead of the current age of 21.

While the proposal to knock two years off of the child support was suggested for the purpose of making Indiana potentially eligible to receive additional federal funding, the proposed legislation would also be beneficial to divorced dads ordered to pay child support during those years.

When states try to lower the age of emancipation for child support, the hope is the number of court cases regarding non-payment of child support will be reduced, the number of people found in contempt of court for non-payment of child support will be reduced, and the number of people incarcerated for failure to pay child support will be reduced.

oklahoma city divorce lawyerQuestion:

My child support question is about state child support laws trumping what we agreed to in our divorce settlement.

Our divorce decree states I will pay child support until my daughter turns 18. She just turned 18 so I stopped paying child support, but the enforcement agency says I have to continue paying until she graduates high school.

My divorce decree says nothing about paying until graduation, but I was told that is the state law. I was unaware the child support enforcement agency could trump a legal document.

Do they really have the power to do this?
