St. Louis divorce lawyerQuestion:

I need to know the correct procedure I need to take to get back child support dropped or even modified.

At the beginning of our marriage separation period she started receiving government assistance which in turn led to me having child support garnished from my paychecks. She said she took care of the situation and child support stopped being garnished.

Now, several years later, child support is coming after me saying I have failed to pay child support his entire time. So even though no money was being garnished, my arrears were apparently building up.

The child support enforcement agency is just treating me like a "deadbeat dad" and won't listen to my case.

How can I get child support modified?

St. Louis divorce lawyerQuestion:

What are the legal collection methods for unpaid child support?

I owe back child support and am paying through a wage garnishment.

Can the child support enforcement agency also freeze or garnish my bank account to take those assets as well?

child support collection practicesBy Jennifer M. Paine

Ever feel like you cannot get out of the cycle of child support collection? You may have fallen behind and just got caught up – and then, wham!

Suddenly, you receive a notice for a tax refund intercept, a notice for a hearing to explain why you have an arrearage, an income withholding order that can take away up to 65% of your pay, a passport revocation letter, a boot on your car, or a combination of these things.

For many guys, this a cycle that keeps on going, and going, and going, until their children are grown adults, living out of home and having children of their own.

Child support collection becomes the task of a state worker with one goal in mind – to have you paying the state in interest and penalties, for years and even decades after your child support obligation terminates.

But is this fair?

child supportQuestion:

How do child support laws handle the wage garnishment termination for past due child support?

I have paid off my child support arrears in whole. Yet, I continue to have money taken out of my paycheck via wage garnishment to the point that now I have overpaid my child support obligation by several thousand dollars.

How can I cease the wage garnishment and collect the overpaid child support?

Mens divorce lawyerQuestion:

Child support is bankrupting me. I have a part-time job making minimum wage yet I am ordered to pay $500 a month in child support plus an extra $200 to cover arrears I accrued while unemployed.

My wages are garnished along with them garnishing half of my unemployment benefits.

Can they charge me this much child support and apply two wage garnishments when I make very little money?
