advice on divorceQuestion:

In my recent divorce ruling the court order leaves me with an inability to pay my ex-wife what the court awarded and still have enough money to live on.

Is there anything I can do? How can a court order a financial award that is above the means of the paying party?

My ex-wife has filed a motion to suspend visitation.

How can I fight this baseless motion and defend myself against her false allegations?

advice on divorceQuestion:

Are the factors below enough to qualify me for a child support modification?

I pay child support and for my child's after school care, though that payment is not mandated by the court.

However, I have learned that I am paying for my child's after school care so that my ex-wife can work a significant amount of overtime resulting in a much higher income than she reported.

Could I get a modification of child support based on her previously unreported overtime pay and the fact that I'm paying for child care costs that the court does not know about?

advice on divorceQuestion:

With a possible child custody modification facing me where my daughter would move in with my ex-wife, my financial burden will be too much to handle.

Our property division settlement already has me paying a substantial monthly payment on property we own, and if my child moves out and I have to pay child support then my debt load will be unbearable.

I have read that it is impossible to modify the property settlement. What are other legal options available to me if the child custody modification is approved?

advice on divorceQuestion:

I am in search of parenting advice on divorce.

My kids have decided they no longer want to live with me and our child custody schedule has switched so they live with their mom most of the time.

They still want me to give them computers and iPods I bought for them and have kept at my house. It's sad they care more about their possessions than me.

Do I have to give them the gifts? Could I just keep them for when they come to my house for visitation?
