Divorce Attorney Angela FoyQuestion:

My wife is addicted to drugs. I left the home 6 months ago and moved a few hours away without the children because I couldn't afford a divorce lawyer. CPS now has the children in their custody because of my wife's drug abuse.

The problem is I am being told nothing by the CPS and they have even added me to the petition because it happened in our home.

What are my rights as a father (who had already filed for divorce and asked for custody in another county when children were removed) as far as CPS goes?

My ex-wife took my daughter to Taiwan for what was supposed to be 6-month vacation. I agreed to it so my daughter could get the experience.

Now she is asking me to sign a paper for her to get a resident visa and states she wants stay there for another year.

Can she obtain a visa without my signature? What about my visitation rights? I only agreed to a 6-month period, not a year and a half!

My wife took our child out of school and moved to another state saying I won't be able to see my daughter until I file for divorce.

Since there are currently no court orders, can I take my daughter back and move her back home?

And what are my visitation rights when there is no court order in place?

Divorce Attorney Angela FoyQuestion:

In lieu of my ex-wife taking part of my retirement pay and not having to pay her maintenance, I agreed to pay her Section 71 payments for a set amount of years.

However, I have since changed jobs to a lower-paying position, and I can no longer afford the ordered payments.

Does the usual standard for modification of maintenance apply to Section 71 payments?

My ex-girlfriend made certain allegations about me in her home. Normally I think this would fall under the expectation of privacy law. However, her parents were in the room when she made her allegations.

Does this still count as expectation of privacy? If I recorded these allegations, would this be admissible evidence?
