I chose to file for legal separation from my wife for various reasons. We have been separated for 2 weeks. In North Carolina a couple must be separated for one year before they can file for divorce. I need some marriage separation advice on how to protect my personal property during a divorce.

After I asked my wife for a separation, she served me with a restraining order prohibiting me from entering the marital home. Later at court, I was granted access to the home in order to collect my personal property but everything I owned was gone.

How can I be compensated for this loss of property due to the restraining order?

I need advice on divorce. I believe my wife has been having an affair with her ex-boyfriend. I found their online conversations on our computer and I have seen her car outside of his house.

Based on what has happened, do I have grounds for pursuing criminal conversation/alienation of affection against this man who destroyed our marriage?

My new husband is going to join the military, and I have a son from a previous marriage where I have primary custody and my ex-husband gets our son every other weekend.

What are the chances that I will be able to get the custody agreement changed to where I can have my son during the school year and move out of the state or the country with my son and husband and let my ex-husband have him during the summers?

Question:

My ex-wife has refused to allow me visitation with our children after she was able to get a default divorce judgment against me since I wasn't aware of any divorce proceedings.

The judgment states that my visitation rights will only be enforceable "by application made on behalf of the defendant." 

I have no idea what this "application" is or what my next step should be to get parenting time with my children.
