At Cordell & Cordell, we advise our clients on the perils of moving out of the marital home before or during your divorce. In fact, it's listed as one of "The 10 Stupidest Mistakes Men Make When Facing Divorce" in Cordell & Cordell co-founder Joseph Cordell's book.

The party that moves out is less likely to receive primary custody of the children, less likely to be granted possession of the marital home by the judge, and has little control over what is done with property located inside the home.

But if you smartly refuse to move out and your wife, in all likelihood, also refuses to leave the home, what are your options to get her to move out so you are not stuck sharing a living space with the person you are least likely to want to see?

Acknowledging the fact that some family law judges are starting to give fathers a fair chance in their courtrooms, Joseph Cordell points out that those judges are still in the significant minority.

"Unfortunately, the majority of fathers find themselves in a situation where the entire family law system has a mindset that is contrary to the dad's best interests," Cordell said while appearing on the radio show Dresser After Dark with Michael Ray Dresser. (Listen to the full interview.)

That system doesn't just include unfair judges; it also includes social workers, psychologists, opposing counsel, and even state legislatures, according to Cordell.

Attorney Joe CordellThe double standards and challenges men and fathers face in divorce was one of many divorce issues Joseph Cordell discussed on the McCarthy and Friends Show on 94.1 KPVR in St. Louis.

While acknowledging progress has been made in granting more father's rights, Cordell said the whole idea is to focus on trying to get the courts to be completely gender blind, which has not happened yet.

As an example, Cordell cited cases where the wife was a highly paid businesswoman and the husband was unemployed or underemployed so he would stay home with the children. Yet the husband is judged by the court as a deadbeat.

"For the most part, judges and opposing counsel see the situation and say, 'Why doesn’t this guy go out and get a job?'" said Cordell.
