Ask a Divorce Lawyer: Can I keep my teenage son from traveling even if my wife approves of it?

Posted by Matt Allen in travel , Jennifer Paine , Cordell Cordell, PC , Children , Ask A Lawyer

Question: I am a divorced dad with a 15-year-old son.

He met a girl on MySpace and is planning on flying to Arizona in two weeks to stay with her for four days.

His mom is OK with this, but obviously I am not. They are now saying his mother is flying out with him.

I asked for some kind of confirmation and she will not provide anything. What can I do?

Ask a Divorce Lawyer: My wife went overseas with my son against my will. Where do I stand legally so she can't do this?

Question: My wife left me and took our son on what she calls a “sabbatical” to review our relationship shortcomings. Turns out, she’s in Switzerland staying with her father. She said she intends to return in 2 weeks.

Where do I stand legally, and how can I take steps to ensure that she cannot do it again? I don't see why our not getting along means that I don’t have access to my 2-year-old son.

Ask A Lawyer: Trips Out Of The Country For Custody Dad

Posted by Rick Ortiz in travel , Spencer Williams , Cordell Cordell, PC , Ask A Lawyer

Question:

I am the custodial parent and was recently permitted to relocate with my three children from Washington to Massachusetts for work. The mother lives in Washington and has no contact or visitation with the children. I want to take my kids out of country to Canada on some short weekend trips and have tentative plans for a two week extended trip to Europe with my oldest (7) in the next two years.

What steps do I need to take in order to take my children out of country? How can I combat this if the mother refuses?

Question:

I am the father of a 5-year-old son and I have joint shared custody of my son. His mother has primary residence, but still have him 40% of each month at my residence. It clearly states in our divorce decree / parenting plan that she is to pay for ALL daycare expenses, which until recently she has done. Well our son starts kindergarten next week and she has changed her work schedule around so that she will no longer require daycare on her end she says that if I needed daycare for the days that I have our son, I will have to pay for it out of my pocket. I told her she was violating our court agreement, she disagrees. In addition, She is supposed to pick-up our 5-year-old son from my residence every other Friday morning and take him to daycare/school (by her residence) but has repeatedly refused to do so. In fact I
