Among the Ask a Divorce Lawyer questions answered today by Cordell & Cordell attorneys:

  • Do I have any say in my wife's and children's living arrangements while we're going through a divorce?
  • How can I keep my ex from repeatedly filing motions because she doesn't like the outcome?
  • Our decree says we have to meet halfway to exchange the children, but both of us have since moved. So does the halfway rule still apply?
  • I got married in the Philippines, so does the marriage apply here in the U.S.?

Ask a Divorce Lawyer: Doesn't child support and alimony cover transportation costs?

Posted by Matt Allen in Visitation , transportation , Erica Christian , Cordell Cordell, PC , Child Support , Ask A Lawyer , alimony

Question: I have my children every Thursday night and every other weekend. In our divorce decree it says to "equally share transportation." I told my ex due to this I would pick up the children for my visitation and she could pick them up from me.

However, since it isn’t convenient for her she is refusing to pick up the children saying she has to take them to school and the babysitter everyday.

She said her lawyer told her to document the mileage she uses to drop the kids off to school and the babysitter to make me pay for it and to document it as "unwillingness to cooperate with the visitation schedule."

But I am paying well more in child support and alimony than she would spend on gas mileage. So who’s right in this situation?

Ask a Divorce Lawyer: How do you settle an issue that's not addressed in the divorce decree?

Posted by Matt Allen in Visitation , transportation , Erica Christian , decree , Cordell Cordell, PC , Ask A Lawyer

Question: I have primary physical custody and the other parent has our kids two nights a week for dinner only.

Who is responsible for transportation of the kids on those two "dinner nights"? It’s not addressed in our divorce decree.

How do you add a condition to the decree?

Ask A Lawyer: Is She Required To Help With Transportation?

Posted by pmcmahon in Visitation , transportation , Richard Coffee , Cordell Cordell, PC , Children , Ask A Lawyer

Question:

My children are 13 and 10 yrs old and my ex has now remarried and moved to a different county which is about thirty-five minutes away. The divorce decree only states I am supposed to supply transportation during visitation as long as she lived in the same county as myself. Now she is refusing to help with any of the transportation. My visitations are every Tuesday and Wednesday from after school until 7:30, and of course every other weekend.

Question 1:  Is she required to help with this transportation?

Question 2:  Is there a magical age where my children can choose for themselves who they stay with?  Since her new marriage, the boys say they hate both her and her new husband because of the way they are treated and talked to. They want to live with me now.
