Ask A Lawyer: How Do I Stop the Sale of Our House?

Posted by pmcmahon in temporary orders , Spencer Williams , Property , injunction , Cordell Cordell, PC , Ask A Lawyer

Question:

When my mother and father separated, my father was court ordered to continue making payments on the house. He did not make payments and my mother was forced to take a loan out to pay off the house. She died before the divorce was final and now my father wants to sell the house.

The deed was in both names, which I found out the hard way that the deed overrides her will. The thing is that he stopped making payments on the house against court orders and she paid off the house.

What action can I take to stop him from selling the house or be awarded 50 percent of the house as per her will or 50 percent of the selling price of the home?

Ask A Lawyer: Can A Court Reverse A Custody Order?

Posted by pmcmahon in Tiffany McFarland , temporary orders , custody , Cordell Cordell, PC , Ask A Lawyer

Question:

Once there is a "temporary court order" for "physical and legal" custody granted to one parent (mother) on a 5-year-old, what are the chances that the Court would reverse the order in favor of the other parent for custody after the divorce is final?

Preparing For A Temporary Orders Hearing

When a party files for divorce, it is sometimes necessary for there to be a hearing on Temporary Orders. A hearing on Temporary Orders can be requested by either party and may occur at anytime during the pendency of the divorce action. The hearing allows the Court to make orders in relation to custody, possession and access, child support, spousal support and the allocation of assets and debts. These orders usually remain in full force and full effect until the divorce is granted or they may be modified prior to the finalization of the divorce.

Ask a Lawyer: How can I see my child ASAP?

Posted by Dads Divorce in Visitation , Visitation , temporary orders , Parenting , FL , custody , custody , Ask A Lawyer

Question:

My wife and I split up about 6 months ago. She had our baby girl 3 months ago and will not let me see her. I am very upset and want to see my daughter. I have sent letters, went to her house and she still continues to keep my daughter from me. She also failed to put me on the birth certificate. I know I need to do a paternity test, but how can I see my daughter now?

Answer:

I cannot answer your question specifically to the laws of Florida as I am not licensed in that State. I suggest that you file for divorce or legal separation. If FL allows for temporary orders file a Motion for Temporary Custody and Visitation. This will not be immediate and could even take a couple of months.
