Ask A Lawyer: If She Stays In The House, Do I Pay Extra Spousal Support?

Question:

My wife and I are in the process of working out an amicable divorce. We are planning on going the "no fault" route.

I am being told (by a relative who is an attorney helping us prepare for the filing) that if she stays in the house, I would have to pay extra spousal support. In addition, she would not be required to refinance the house, buying me out. Is this true?

It certainly doesn't seem right that we would build equity in the house together over the years we have lived in it and, after the divorce, I would still help her build equity!

Question:

My wife and I filed for divorce over a year ago. I was the respondent, and have finished all my paperwork & have not received anything back from the courts. Almost every month she tells me she received the paperwork back and has to pay to have someone help her. I have offered to pay just so we can get this done and she refuses.

Finally, I called the court to see where the problem was, and they told me they are waiting for her to finish her part. What can I do to speed this up?

Question:

I just recently agreed on child support and spousal support. I settled out of court with my ex-wife and her attorney. However, I didn't have an attorney and now I feel like I was taken advantage of.

I don't have the money for an attorney but I feel like I should have one look over my papers to see if I was steamrolled.

Is it too late at this point?

Question:

My wife and I have been married for 11 yrs but we've been together for over 20. Most likley we will be getting a divorce soon and I want to know how much I will have to pay in spousal and child support? I have two sons; a 16yr old and a 8 month old. I make about $70, 000 a year and she makes about $14,000. We own a home, 3 cars and I pay all the bills and buy groceries. Also, what will happen with our home?

Answer:

I am not licensed to practice law in Illinois. However, it is my understanding that child support is 28% of your net income. Spousal maintenance is at the discretion of the court and there is no exact formula. There are many factors that may determine if she would be awarded maintenance. I recommend using the online child support calculators or consulting an attorney in Illinois to determine what your exact obligation may be.
