Helping Yourself by Taking a Broad Family View

Posted by Rick Ortiz in settlement , settled divorce , mediator , FL

Understanding the Collaborative Approach By: Kim Douglas Sherman, Esq.
I am a dad, and I am an attorney practicing family law in Florida for over thirty years.  In those years I have seen some colossal battles over children.  Most of the time, when emotions are running high, one of the parents decides that the best way to inflict pain on their soon-to-be ex-spouse is through the children.  That decision is one of the WORST that a divorcing parent can make.  This article contains some effective strategies, and couple of reasons to avoid the urge to use the kids as a weapon.

Sure, you have heard of “what goes around comes around.” I tell my clients that it is truer than you can imagine. It is not just that the mother will have a chance at some time later to take her shot back—but in the many years following the divorce, while the children grow into adulthood, then parenthood– their mother will have many chances to get even.  Children want to love their parents and respect them.  It seems that as the children grow, they figure out what really motivates their parents’ actions, and then they take the hostility personally.

Ask A Lawyer: Do I Pay For Wife's Legal Fees When Her Case Was Pro Bono?

Posted by pmcmahon in settlement , pro bono , Legal Strategy , Cordell Cordell, PC , Claudia Weaver , Ask A Lawyer

Question:

My wife got an attorney through a legal aide society. Her attorney took on her case as pro bono and is attempting to slam me with her fees.  According to the settlement offer I just received, I am to pay $5000 for my wife's legal fees. Does her attorney have the right to charge me even though she took it on as pro bono?

Ask A Lawyer: Do I Get 1/2 On Proceeds From The Sale Of The House?

Posted by pmcmahon in settlement , Richard Coffee , property issues , Property , Cordell Cordell, PC , Ask A Lawyer

Question:

I realized recently that I received no money from the sell of the house that my ex wife and I lived in while married. My name was not on the loan for the home. The loan was in my ex wife's name and her mother was the co signer.

Should I have still received 50% of the money received from the sell of the house?

Ask a Lawyer: Can grandparents interfere in negotiating a settlement?

Posted by Dads Divorce in TX , settlement , negotiation , interference , Infidelity , grandparents , Ask A Lawyer

Question:

My question is very simple. My ex wife and I are negotiating a settlement, prefeably a shared custody which we feel is best for the children. Her father has taken over all negotiations and made several references to court action if I dont accept his tentative agreement. What is the law's position on the grandparent getting so invoklved in matters like this? (Texas)? Many thanks

Answer:

I cannot answer your question specifically to the laws of Texas as I am not licensed to practice law in that State. In my jurisdiction, intervention by grandparents is only appropriate if there is an issue with the parents. Assuming you are both willing and competent, he should not be involved.
