Question:

My wife got an attorney through a legal aide society. Her attorney took on her case as pro bono and is attempting to slam me with her fees.  According to the settlement offer I just received, I am to pay $5000 for my wife's legal fees. Does her attorney have the right to charge me even though she took it on as pro bono?

Question:

I realized recently that I received no money from the sell of the house that my ex wife and I lived in while married. My name was not on the loan for the home. The loan was in my ex wife's name and her mother was the co signer.

Should I have still received 50% of the money received from the sell of the house?

My question is very simple. My ex wife and I are negotiating a settlement, prefeably a shared custody which we feel is best for the children. Her father has taken over all negotiations and made several references to court action if I dont accept his tentative agreement. What is the law's position on the grandparent getting so invoklved in matters like this? (Texas)? Many thanks

Answer:

I cannot answer your question specifically to the laws of Texas as I am not licensed to practice law in that State. In my jurisdiction, intervention by grandparents is only appropriate if there is an issue with the parents. Assuming you are both willing and competent, he should not be involved.

Question:

Are payments from a private disability insurance considered as part of a settlement? I had to sell my practice due to disability. I receive a monthly payment from insurance for the rest of my life. Is my wife entitled to a portion of this income?

Answer:

It depends. Will your wife ask for alimony/maintenance? If so then the disability may come into play as to whether you are able to pay her maintenance. Otherwise, generally disability is not considered property for purposes of division of assets. The proceeds from the sale of your practice would be viewed differently though.
