Ask A Divorce Lawyer: Would a "No Inclusion" clause work against me?

Question: 

My attorney suggested I add a "no inclusion" clause in my separation agreement so that the agreement can't be used in the divorce proceedings. The separation agreement grants me joint physical and legal custody, and does not require me to pay child support. Does this no inclusion clause work against me?

Question: I have not been living with my wife for the last 6+ months. She is an alcoholic. I’ve told my kids not to get in the car with her if they suspect she’s been drinking at all. If she gets in an accident driving, what can I do to protect my kids from her?

Question:

My estranged wife and I entered into a separation agreement 2 years ago. It was prepared by a friend of hers and it has proven to be very unfair to me. I was not informed of inheritance laws and child support guidelines before it was signed.

It was never filed with the clerk's office until I filed for divorce this past January. Then her lawyer filed it. I filed on grounds of cruel and inhuman treatment, not the agreement that was made.

Is there a time limit on how long an agreement can be held and not filed? How should I proceed?

Question:

My husband and I are separated. He just received a big worker's comp check. Is there any way I can garnish it to get half to pay debts that I need help with due to his abandoning me?

Answer:

Allow me to preface my response with the disclaimer that I am not licensed in the State of Maryland. You can not garnish because you do not have a Judgment against him. But some or all of that award may be marital money, so if you file for divorce, the Court may divide it or at least freeze the account until it is divided.
