Ask A Divorce Lawyer: Can I send the IRS the divorce decree if she refuses to sign the proper forms?

Question:

Every other year I have the right to claim my daughter on my taxes. This year is my year. We have joint custody and my ex-wife has primary physical placement. She is refusing to sign the form 8322 simply due to stubbornness and not because of any legal issue.

Can I send a copy of the divorce decree to the IRS to satisfy the form 8322 if she won’t sign it? Her refusal could substantially delay my tax return.

Question:

I have a son who is 13 months old. His mother and I were never married and we separated when he was one month old. We have never been to court for custody or anything, and we pretty much equally split the time with him. Given our arrangement, I was wondering who should claim the child on their taxes, or can we both?

Question:

My wife and I are having an extremely difficult time right now on account of her troubles with severe depression and obsessive-compulsive behaviors. We have been together for almost 10 years, but the situation is worsening. I don't think I can stay any longer.

I feel very strongly that I should be our 3-year-old son’s primary caregiver. I’ve considered leaving the house and taking my son with me the situation is so bad. If I do that, will it be considered kidnapping since my wife doesn’t want us to leave? It’s unhealthy for us to continue to live there and I want to get my son out of there. Do I alert the courts that I’m moving out?

Question:

 

I have a daughter who turned 18 and the support contract ended at that point. Then the state of Oregon sent my daughter a form to fill out so support would continue while she was going to college. I don’t feel I should have to be responsible for her now that she is an adult. I was wondering if I could emancipate myself from her some how or if there was some other way to get the support to stop?

Question:

My brother needs to get custody of his kids. He and his wife are having troubles because she is out partying all the time lately and always leaving him with the kids. What proof does he need to help his case for custody showing that she is not a fit mother?
