Ask A Lawyer: How Do I Get Uninterrupted Time With My Children?

Posted by pmcmahon in Visitation , right of first refusal , Parenting , Erik Carter , custody , Cordell Cordell, PC , Ask A Lawyer

Question:

I am wondering what the laws are on several issues.

1) On the weekends that I have our children, my ex-wife continually schedules appointments for them that interrupt my parenting time. What are the laws that protect my time so that it is uninterrupted?

2) We have a 13 year old son that my ex-wife wants to continue taking to a babysitter (her mother) on my weekends. However, my current wife is available and would be more than happy to be with him until I get home from work. What are the laws on right of refusal that allow me to exercise my parenting time as I see fit?

3) On the days that I have my children, am running 30 minutes behind and cannot pick them up on time, can I have my wife pick them up? Or does the decision get to be made solely by my ex-wife? Our current custody agreement is 51% for my ex-wife and 49% for me. Is there a site where I can look up specific laws to protect my rights for uninterrupted time with my children?

Book Excerpt: Misinformation From the Stepmothering Industry

Posted by Rick Ortiz in stepchild , step parent , remarriage , Parenting

by Wednesday Martin, Ph.D., Author of Stepmonster: A New Look at Why Real Stepmothers Think, Feel, and Act the Way We Do

Books for stepmothers tend to perpetuate certain myths. The myth of the blended family and the myth of the maternal stepmother are the most glaring examples. These books' relentlessly upbeat tone can make stepmothers feel as though our own occasional negativity and impatience regarding his kids are freakish. Other books on stepmothering are so lighthearted, so insistent that we see the humor in our situation and in our responses to it, that reading them feels suspiciously like being told that our concerns don't matter and that we just need to lighten up. But the real problem with many books for stepmothers is not what they imply, but what they actually say:
  • Remember that his kids will always come first.
  • Leave the disciplining to him.
  • You will regret it forever if you lose your temper or say something nasty to your stepchildren, so whatever you do, don't.
  • With patience and love, they will come around.

The fact that these directives have become a virtual mantra, the unassailable golden rules of stepmothering does not mean that they are right.

Ask a Lawyer: COMPTEMPT

Posted by Dads Divorce in Visitation , Parenting , GA , custody , Ask A Lawyer

Question:

I have custody of my 9 year old daughter. I have had custody for about 4 years. My ex wife is always doing things against the court order. Can I file contempt without lawyer?

Answer:

Every state will have differing laws on this issue. I am not licensed in Georgia so you should consult an attorney in your state before taking action. Most states will allow you to represent yourself. Keep in mind that you will be held to the same standards that attorneys are if you chose to go it alone. If the contempt is non-payment of child support contact your local prosecutor. Many prosecutors will assist in the enforcement of child support at no cost. If the contempt is something other than support contact your local bar association or legal aid for guidance. There may be low or no cost attorneys available or free forms. Keep in mind that if your ex is in contempt it may be possible to get an award of attorney fees.
