Ask A Lawyer: My Brother Is Not Married, But Doesn't He Still Have Parental Rights?

Posted by pmcmahon in Visitation , paternity , Parenting , parental rights , Erik Carter , Cordell Cordell, PC , Ask A Lawyer

Question:

My little brother is having issues with his on/off girlfriend who keeps taking their daughter away from him and then she decides to come back to him. He supports both of them, and she doesn't work or even go to school. I would like to help him have custody over their daughter but I don't know where to start. Does he have any rights if he is not married to the mother of his child? Any help you can provide me to start the process of getting some type of custody would be greatly appreciated.

Question:

I want to have my daughter overnight on the weekend before I leave for the service next month. My daughter is almost 4 months old. I have had her once a week since she has been 2 months old. I pay everything for my daughter and have been trying to keep this out of court until I get back from my tour. Do I have any rights without a court order?

Ask A Lawyer: How Do I Regain My Parental Rights?

Posted by pmcmahon in Visitation , Richard Coffee , Parenting , parental rights , Cordell Cordell, PC , Ask A Lawyer

Question:

I have lived and worked in the Texarkana area for the past six months. My wife and daughters still live in our home in Harper, Texas. I told her last week that I wanted a divorce. She got the church involved and they had her take the kids away this weekend when she knew I was driving down to see them. The church instructed her to hide my children from me, even to take their cell phones so I would be unable to contact them. My wife will not answer any of the phones and she will not let my daughters call me.

I have not filed for divorce yet, but will. How can I regain my parental rights?

Ask A Lawyer: Can She Regain Joint Custody?

Posted by pmcmahon in Richard Coffee , Parenting , parental rights , joint custody , Cordell Cordell, PC , Ask A Lawyer , abandonment

Question:

My daughter and her ex share joint custody of their child.  A while ago, my daughter moved to Arizona where just last year she began having some problems and sent her daughter to stay with dad until she was better. During that time, the dad filed abandonment papers and my daughter lost custody. A registered document was mailed to my daughter, but it was sent to her old address so my daughter never received it.

Can she regain joint custody and how much does this process cost? Can this be done free through court documents or a legal library?
