Ask a Lawyer: Mother wants to take children back to Australia

Posted by Dads Divorce in non-custodial parent , moving children out of country , Legal Strategy , injunction , FL , Ask A Lawyer

Question:

I am an Australian citizen living in Florida. Recently I divorced my wife. We have two children. Now she wants to take them back to Australia. Can I call US customs or anyone else to stop her from taking the kids to Australia?

Answer:

I am not licensed in Florida. There are usually laws that govern removing children from the country without the non-custodial parents permission. I would contact your divorce attorney to see about getting a temporary injunction preventing the move.
