Ask a Divorce Lawyer: My ex wants to move my kids out of the country. Can I stop her?

Question: My ex-wife wants to take our three children to live in Mexico. They were all born in the U.S. I do not want them to go. 

What are my legal rights in this? 

The divorce decree does not specify anything about an international move. I’m not sure if this makes a difference, but she does have family in Mexico, including her new husband.

Question: My girlfriend lives in New York and has children from a previous marriage. There is currently no custody order in place. 

Would she be allowed to move out of the country with the children since there’s no order?

Question:

I am an Australian citizen living in Florida. Recently I divorced my wife. We have two children. Now she wants to take them back to Australia. Can I call US customs or anyone else to stop her from taking the kids to Australia?

Answer:

I am not licensed in Florida. There are usually laws that govern removing children from the country without the non-custodial parents permission. I would contact your divorce attorney to see about getting a temporary injunction preventing the move.
