Ask A Lawyer: Is There A Statute of Limitations On Submission Of Medical Expenses?

Posted by pmcmahon in statute of limitations , Richard Coffee , medical , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question:

In my divorce decree, I was ordered to pay 50% of extra medical expenses when submitted to me by my ex. Is there a timeframe/Statute of Limitations for her to submit these? I recently received a request for the past 5 years of extra expenses and want to take a position that is supportable in court. Is there any general protocol that one should follow when submitting requests for payment regarding things decided in court? What are the chances that I can make payments because the lump sum would really hit me hard right now?

Ask A Lawyer: Is Withholding Medical Documents Considered Contempt?

Posted by pmcmahon in Richard Coffee , parental rights , medical , Cordell Cordell, PC , contempt , Ask A Lawyer

Question:

My son was injured during a recent visit with his mother; however I was only informed about the incident after I noticed the chip on my sons tooth and scrapes on his face. I was told that she took our child to the ER, but I have been asking for the documentation for this event for about six months.  I still have yet to see any documentation of my son's visit to the ER.

Can I hold her in contempt since it is in our child and visitation order that we both have the right to get any type of medical documents when asked for?

Also, if I do file, do I need to travel all the way to Virginia since the children and I are residing in Florida?

Ask A Lawyer: Responsible For My Out-Of-Wedlock Baby?

Posted by Rick Ortiz in Richard Coffee , medical , Cordell Cordell, PC , Ask A Lawyer

Question:

I fathered a baby out of wedlock. The birth mother wants me to pay the doctor and hospital bills. My insurance paid for the baby's expenses.

Am I legally liable for the medical bills in her name? She also thinks I should compensate her for her lost wages when she stayed home with our daughter.

Is there any legal basis for her to make this claim?

Question:

Is there any documentation governing what items are covered under child support? My wife asked me to buy some sneakers and I thought that was covered under child support.
