Ask A Lawyer: How Do I Immigrate My Daughter To The US?

Question:

I am a legal resident of the United States of America and I have a 3 year old daughter currently living in Mexico. The mother has informed me that she can no longer take care of our daughter and gave me full custody of her.

I need to bring her to the United States, but I am afraid for her safety. Can I just bring my daughter to live with me in the US, or is there a process for this?

Question:

My wife recently informed me she was unhappy and wanted to leave. She indicated that she was going to move out and take our 2 girls with her to a new apartment. Taking either of the children out of their home and comfort zone would be detrimental to their emotional development, not to mention my oldest daughter is diagnosed with ADD and anxiety disorder.

With their mother wanting to leave and remove the kids from their home, I believe this is the worst thing we could do to our children. What are my options to keep them in their home and allow her to leave?

I do not want to eliminate her from their lives but taking them out of their home and school in wrong. Their is no abuse in our home and she is a good mother. Please advise me on what my legal rights/options/strategies are?

I worry sometime down the road, my ex will take my daughter across country to Virginia. We live now in Arizona. Being unmarried, how do I stop this? Thank you, BD

Answer:

Answer: You have no rights to the child until they are established by the court. You need to file a Motion for Determination of Father-Child Relationship (paternity action) to establish your physical custody and legal custody rights to your daughter. Once a physical custody and visitation arrangement is established she would need follow that order.
