Ask A Lawyer: How Do I Keep The Ex From Interfering With My Visitation?

Question:

My ex-wife is constantly interfering with my Indiana minimum visitation time, she broke the "first right of refusal" by hiring a babysitter for the kids about 12 times last month. My lawyer told me that we cannot do anything and that there are worse cases than mine.  Further, my lawyer stated that she cannot contact the judge because he is too busy. Is this something that I have to just "suck up" and take as my lawyer says, or should I get another counselor?

Question:

The mother of my daughter says they are going to Disneyland and it will cut into my visitation on Father's Day.  Is she allowed to do this?  What can I do before that day to stop this?  If I wait to resolve this later, she'll just take her without regard?

Ask A Lawyer: How Do You Handle Visitation With An Interfering Ex?

Question:

When does it end?  Court order by Cambridge court that a father gets visitation for the week of Christmas - a week in March and the month of July. The month of July is if the child wants to stay with the father during that period of time.

The mother each and EVERY time interferes. The child (14 yrs in the coming august) has said the mother writes things down on a piece of paper and tells her what to say. The child then says when she does not say what is written the mother gets very angry. The child is now being told she CANNOT come in July.

This is now the second year I have had to deal with this. Of course, the easy solution would be to take it back to court. But, the decision was already made by the Judge. How do we proceed?

My question is very simple. My ex wife and I are negotiating a settlement, prefeably a shared custody which we feel is best for the children. Her father has taken over all negotiations and made several references to court action if I dont accept his tentative agreement. What is the law's position on the grandparent getting so invoklved in matters like this? (Texas)? Many thanks

Answer:

I cannot answer your question specifically to the laws of Texas as I am not licensed to practice law in that State. In my jurisdiction, intervention by grandparents is only appropriate if there is an issue with the parents. Assuming you are both willing and competent, he should not be involved.
