Ask A Lawyer: Can I Get A Divorce But Keep Her On My Insurance?

Question:

I am currently separated from my wife and we have split custody of the kids. I have custody of them for about 98 hours per week, and she has them for around 71 hours per week. Now, I would like to file for divorce so we can both move on with our lives. We make about the same amount of money, but I make a little extra because I get shift differentials at my job. Eventually, she will make more money than me since she is studying to be a registered nurse.

How should I proceed with filing a divorce? Even though I want to get the divorce, I still want to have her and the kids on my health insurance until she becomes a registered nurse.

Ask A Lawyer: Do I Have To Agree Before Being Removed As Beneficiary?

Question:

My wife and I were separated for about 10 months. A few months ago, separation papers were filed after undergoing mediation and not reaching a resolution. She was diagnosed with a brain tumor and died about 3 weeks ago. She made her mom Power Of Attorney about one year ago. I was the beneficiary on her life insurance policy until two days before her death, at which time her mom took me off as beneficiary and placed my children as beneficiary. She also sold her car about two months ago, after separation was filed. My understanding was that all legal issues and assets are supposed to be frozen until determined by the court. Her mom never allowed us to progress with legal matters, so we were in "limbo" for about the last year. I have heard that in some states the husband has to agree to be removed as beneficiary. What are my legal rights?

Ask A Lawyer: Am I Responsible For Half Of the Cost For Braces?

Question:

My children have insurance & dental, however braces aren't covered under the current policies.  My ex is wanting to get our son braces and is telling me I must pay half of the cost although he doesn't have to have them. As a matter of fact, she makes me pay half of my co pay on regular insurance matters.

Can she force me to pay half of the cost for braces? If she can get another dime out me, she will. I'm just wondering if she can force me to pay for something that is not needed?

Question:

My soon to be ex-wife and I were in an accident about two years ago and we have a pending law suit in which the initial claim is two million dollars.

Since my wife is filing for divorce, does this potential settlement enter into the financial affairs of the divorce and accordingly marital property?
