Ask a Divorce Lawyer: How should I deal with an unfair guardian?

Question: I am in need of help getting to see my kids! It has been almost 4 months since I have seen them. 

My ex and I have a parenting plan where I had the kids Monday and Tuesday and every other weekend, which was working great until the guardian stepped in. I will admit since the guardian stepped in I have not been a saint but she has been working against me the whole time and I feel worn down. 

Now I can't even see my kids supervised. What am I doing wrong? What can I do?

Ask A Lawyer: Does A Child's Opinion Decide Custody Arrangements?

Question:  I am the custodial parent and have been divorced for almost two years. My 15 year old son wants to stay with his father who doesn't have a good record due to drinking and a DUI.  His father also works nights and is never home. He is letting our son do what ever he wants and as a result our son is falling behind in school work. Is it possible that my son's opinion on this matter could get custody overturned? He gets to do whatever he wants when he goes to his fathers which is why he wants to go there.

Custody Mediator Or Guardian ad Litem: Which Do You Need

What do you do when you get correspondence from your attorney and you see that your proposed parenting plan and your-soon-to-be ex’s differ by only one overnight? What do you do when you think your soon-to-be-ex has a serious drinking problem, and you think you’d be the better parent to have sole custody? Does custody in either situation just have to be tried? Is the Judge going to try to force custody in either situation to settle?

In many of the jurisdictions in which I practice, the Court has a local rule which requires the parties to attend at least 1-2 hours of mediation when there is a custody issue within the case. If there is no local rule requiring such mediation, there are oftentimes free mediators within the Court system that can be appointed to a case to help to try to resolve custody issues.

Ask A Lawyer: I Think My Kids Are In Trouble, What Can I Do?

 Question:

I have been divorced for thirteen years. We have a seventeen year old daughter and a fourteen year old son. Both of our children have had a considerable drop in their school grades through the past four years. In fact, my daughter has recently been caught by police with alchohol, cigarettes, and pot!

Mom does not want to deal with it. I want to have a gaurdian ad litem involved . How can I do this?

I am also concerned of the new stepfather's police history. Mom implies that he has a history of sexual misconduct, but that he is better now. Any advice as to how I can get this information and what I should do to deal with this problem once I have it?
