Question:

Is it legal for my fiancé’s parents and mother in law to deny him his son's phone number and visitation rights? Right now he is not allowed to call his son or to take him out alone. These are the rules of the grandparents, not of the court. There is no court ruling him to be an unfit parent or anything else for that matter. The child just lives with the grandmother in New York while the father is in Maine.

My ex daughter-in-law moved out of state. Currently my son is trying to get kids back. In the meantime she will not allow me to have any contact with the kids. What can I do? I have limited amount of money. Can I file papers without an attorney? I raised these kids for over 1 year, do I have rights?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Kansas. Some states do have grandparents' rights that allow you to seek visitation. Usually it involves a denial of time with the grandchildren.

Question:

My wife and I are retired, very stable, and very happily married. Our son and his ex-wife are divorced and not stable in any way ranging from employment to psychological. Can we as grand-parents get full custody of their child?

We have been helping raise the child since birth, taking him for weeks at a time while they get it together, get out of jail, get their meds straight, etc.  What are the first steps toward doing this?

We are just worried about both parents' history of making bad and dangerous decisions, but we don't want to risk that our granddaughter might end up with a foster family.

Ask a Lawyer: Can grandparents interfere in negotiating a settlement?

My question is very simple. My ex wife and I are negotiating a settlement, prefeably a shared custody which we feel is best for the children. Her father has taken over all negotiations and made several references to court action if I dont accept his tentative agreement. What is the law's position on the grandparent getting so invoklved in matters like this? (Texas)? Many thanks

Answer:

I cannot answer your question specifically to the laws of Texas as I am not licensed to practice law in that State. In my jurisdiction, intervention by grandparents is only appropriate if there is an issue with the parents. Assuming you are both willing and competent, he should not be involved.
