Ask A Lawyer: How Do I Keep My Wife From Ruining My Finances?

Question:

What are the consequences of closing our shared savings and checking so I can control the money? Over the last year, my wife has run up a shared Visa buying shoes and a wardrobe. I do not trust my wife since we were just in a 2-month separation.

I'm back in the home now, but she shows no signs of love, desire, nor hope. In the mean time, I found out her Mom sent her a bit of money a few years ago. She also opened a credit card in her name and is using it to pay our mortgage and other home bills on a monthly basis. She then pays the Visa using our shared checking account. I think she has been building and establishing credit. 

I earn the money because she refuses to work, and I feel that she is positioning herself to leave me and take much of what I have worked for. Any advice?

Ask a Lawyer: Not getting financial info. from spouse

Question:

I have responded to all requests for financial information including credit card statements, bank statements, 401K, etc. from my wife's attorney. I have asked for the same information but my attorney has not filed for it and she has not supplied it. I feel like my attorney is not acting in my best interest. I'm always on the defense and have had nothing I ask for done. We agreed on a bifurcated divorce last week. My attorney said there was no down side to that. The judge actually admonished both attorneys for dragging this case on and wasting the courts time. I can't go forward in making any decisions until I see what her 401ks, salary and bonus structure of new job, etc. is. She has not been forthcoming with this informtion. How do I get it if my attorney will not demand it?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of California. You need to demand that your attorney demand it. There are multiple ways to get this information (informal requests, formal discovery, subpoenas, etc.) Perhaps your attorney has done the informal version, but not received a response. The formal way has a binding effect with the Court via a compel motion to your wife/her attorney.
