Ask a Divorce Lawyer: My ex is blatantly ignoring our visitation agreement. What can I do?

Posted by Matt Allen in Visitation , Modification , enforcement , Cordell Cordell, PC , contempt , Children , Ask A Lawyer

Question: My ex-wife decided that even though our custody agreement states that we change every Thursday at 9:00 am she kept our daughter until Saturday night for Thanksgiving. In our agreement her lawyer said no to breaking out the holidays and that it would just continue week on, week off.

Now my ex says that the intent was to share over holidays. She advised me by text on Wednesday night at 7:00 pm that she was going to another state for Thanksgiving giving no indication when she would return. I had to wait for her not knowing when she would return.

What can I do?

Ask A Lawyer: Could She Be Found In Contempt?

Posted by pmcmahon in Rules , Procedures , Erik Carter , custody , Cordell Cordell, PC , contempt , Ask A Lawyer

Question:

I was granted an ex-parte order to get custody of our two children.  Now my wife is refusing to return the children.  I have even had the police attempt to get them for me, but to no avail. Can she be found in contempt for this?  If she is found in contempt, will the children be taken away from here and given to me for full custody?

Ask A Lawyer: Can I Get Custody When Ex Is In Contempt?

Question:

Seven years ago I got joint custody of my son with his mother getting primary caregiver. It states in our papers that I must agree upon a school before she moves him. In the past 5 years she has moved him to 4 different schools and this year he may fail. She told him that the school was just too hard.

She never consulted with me about moving him to different schools before. If she tries to move him to another school once again, is there anything that I can do to try and get custody of him so that he can stay at one school?

Ask A Lawyer: Is Withholding Medical Documents Considered Contempt?

Posted by pmcmahon in Richard Coffee , parental rights , medical , Cordell Cordell, PC , contempt , Ask A Lawyer

Question:

My son was injured during a recent visit with his mother; however I was only informed about the incident after I noticed the chip on my sons tooth and scrapes on his face. I was told that she took our child to the ER, but I have been asking for the documentation for this event for about six months.  I still have yet to see any documentation of my son's visit to the ER.

Can I hold her in contempt since it is in our child and visitation order that we both have the right to get any type of medical documents when asked for?

Also, if I do file, do I need to travel all the way to Virginia since the children and I are residing in Florida?

Ask A Lawyer: Can I Stop My Ex From Taking Our Daughter Out-Of-State?

Posted by pmcmahon in Tiffany McFarland , out-of-state , out of state , custody rights , Cordell Cordell, PC , contempt , Ask A Lawyer

Question:

My ex wants to take my 3 yr old daughter out of the state for spring break. I want to know if I have any say in this decision because I really don't think I'll ever see her again.

This is a never ending battle with her always trying to change our custody order or wanting to take her out of the state for weeks at a time.  Please, if you can, help.
