Question:

I have the option of taking a lump sum payout from my employer or a monthly pension when I retire. I assume that if I took a monthly pension, child support payments would be based on that payout plan. But if I take a lump sum buyout, what criteria does the court use to determine future child support payments?

Question:

How can I get my child? CPS has been called on the mother 2 times and yet she seems untouchable. I pay for my child who resides in Missouri. I paid $700 a month when she did not work. She is now married and works yet I still pay $700.

She has neglected the child's teeth for over a year and the school has already been involved. I am still told she is the "fit" parent!

My lawyer just seems totally clueless in helping me do what is right for the well-being of my child! What are some steps I can take toward helping my child?

Question:

I am a substitute teacher. I do not get called for work everyday. I was paying $305 monthly child support as part of an order for protection.

On Jan. 6, 2009, my wife had the order extended. As part of the modification of the order, she asked that my child support amount be increased. The judge asked me what I made per week. Not thinking, I said $400 per week (as I have sometimes worked 4 days at $100 per day). I also have a second job that brings in $140 per week. The judge then upped my child support payment to $1000 per month.

He assumed I made $400 per week from substitute teaching week in and week out. He did not take into consideration the fact that I do not get work everyday, nor that there are many school holidays where there is no work.  Three months of summer will be here soon and there will be no work as well, and I do not continue to get paid when there are breaks.  Do you have any pointers for me?

Question:

My new wife is pregnant and expecting our child in May.Will this be reason to lower my child support?

My ex-wife and our child live in another state.  She has been refusing to get my daughter to the airport in order to come visit me. How do I go about making her be responsible to bring my daughter to the airport to fly to my house when I am supposed to have her?

Question:

I've been divorced for about 3 years and recently my ex-wife took me back to court to raise my child support payments. I have 2 children, ages 7 and 8. I've been told that if both incomes are over 100k, it's up to the discression of the master/judge. My payments now are almost 50% of my take home pay, which seems extremely high to me. What is the maximum amount of child support I could pay? Can I get an accounting of what she spends the money on or why the master set my amount at almost 50% of monthly take home?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Maryland. Generally the Court does not ever order an accounting. They are difficult to receive and they are difficult to enforce. I am not aware of the specific guidelines of the state of Maryland. However you are certainly entitled to have the Court explain via a court order how child support was determined.
