Ask a Divorce Lawyer: Can my wife keep my name off the birth certificate if I'm the biological father?

Posted by Matt Allen in paternity , military , Jennifer Paine , deployment , Cordell Cordell, PC , Children , biological , Ask A Lawyer

Question: My wife and I want a divorce. She is pregnant with our child, and now I am deployed overseas and will not be home for the birth of our child.

She doesn't want to put me on the birth certificate as the father and she wants the baby to have her maiden name.

Is that possible and what can be done? Can I force her to put my name on the birth certificate or have the baby take my last name since it is my child?

Ask a Divorce Lawyer: Do I have to pay child support for my stepson or just my biological kids?

Question: I am considering a divorce from my wife. We have three kids, and the oldest is my stepson and there is a prior custody agreement in place between my wife and her old boyfriend for my stepson. Our other children are 6 and 4 years old.

My wife doesn't work and I'm currently putting her through school against my better wishes given our tight financial situation. We own no property together, have no assets together at all, and no shared savings. I want to try for joint custody and shared physical custody for my two children.

Since my stepson is not in any way linked to me legally, am I off the hook with him legally in terms of child support?

Ask A Divorce Lawyer: Do I have any legal rights when my daughter is not biologically mine?

Question:

I have been married for 4 years. My wife got pregnant during that time from another man and gave birth to a girl. I’ve been raising her as my daughter even though I’m not the biological father and my wife won’t tell me who it is. If I get a divorce, will I have any legal rights to my daughter?

Ask a Divorce Lawyer: Will I get visitation rights for my stepson?

Posted by Matt Allen in Visitation , stepchild , Jennifer Paine , insurance , Cordell Cordell, PC , biological , Ask A Lawyer

Question: I met my wife when she was two months pregnant. We married shortly after the child was born. We refer to him as “our son,” he’s always gone by my last name, we’ve all lived together in the same home. I was not named on the birth certificate due to the fact that we needed state insurance to help pay for the pregnancy. We recently told him who his biological father was. Now my wife and I are going through a divorce, and I desperately want custody of our son or at least legal visitation. I know I’m not his biological father but I’m the only “dad” he knows. Will I get visitation rights with him even though I’m not technically the father?

Also, I am medically retired from the military. I’m afraid when the divorce goes through that the insurance company will drop coverage on my son because he is legally my stepson, not my biological son. He has diabetes and needs good medical coverage, but my soon to be ex wife does not have insurance. What can I do to keep him insured?

Ask A Divorce Lawyer: Can a non-biological father adopt his daughter when the mother leaves her?

Posted by pmcmahon in Visitation , Parenting , Jennifer Paine , custody , Cordell Cordell, PC , Children , biological , Ask A Lawyer , adoption

Question:

When I met my now ex-wife nine years ago, she had a two-month-old daughter. I was obviously not the father but have taken care of her all those nine years. My ex married a man and moved to Vegas last year and said if I did not take our daughter back she would place her in a foster home so I took my daughter back.

Since I’m in no way legally attached to my daughter, what are my rights in terms of adopting her? She was born in Mexico and no father is listed on the birth certificate. The mother doesn’t want her and I’m the only father she knows so shouldn’t this be cut and dry? I don’t have the funds for a lawyer so is this something I can do on my own?
