Ask A Lawyer: Can My Girlfriend Help Me Take Care Of My Daughter?

Posted by pmcmahon in Tiffany McFarland , custody , Cordell Cordell, PC , Ask A Lawyer

Question:

Though there are no stipulations in my divorce decree that I can find, my ex-wife insists that I always be present when my daughter is staying at my house.

My girlfriend of 6 years who is a very stable writer works from home and absolutely loves to take care of my daughter who is 5. My ex-wife, however, keeps insisting that they not be alone together.

This might involve days when my daughter stays home from school when she is sick. My ex says that on days such as those I must take her to the daycare of my ex-wife's choosing because my wife cannot take off from work. My ex has gone so far as to say that I am not allowed to leave my daughter home with my girlfriend if I go out for an errand, such as to get dinner.

Ask A Lawyer: Can A Court Reverse A Custody Order?

Posted by pmcmahon in Tiffany McFarland , temporary orders , custody , Cordell Cordell, PC , Ask A Lawyer

Question:

Once there is a "temporary court order" for "physical and legal" custody granted to one parent (mother) on a 5-year-old, what are the chances that the Court would reverse the order in favor of the other parent for custody after the divorce is final?

Ask A Lawyer: Am I Obligated To Continue Paying Child Support?

Posted by pmcmahon in Tiffany McFarland , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question:

My son (who turns 18 this summer) has dropped out of school. He was previously enrolled in the local high school that didn't work for him...so he enrolled in the Alternative high school. That didn't work for him either and he was expelled. He then was given a chance to participate in the GED program which he also quit.

Now he says he is going to re-enroll in high school in the fall (and not going to school at all until then). Am I obligated to continue child support if he is not actively enrolled?

Ask A Lawyer: Does Child Support Automatically Stop?

Posted by pmcmahon in Tiffany McFarland , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question:

I have no paperwork from my divorce ten years ago. My attorney has since died and his office no longer exists.

My question is: Now that my children are finishing college, will my child support automatically stop or do I need to file papers on anything?

Where do I begin to make sure that my mandatory support stops when it is supposed to?

Ask A Lawyer: Can I Stop My Ex From Taking Our Daughter Out-Of-State?

Posted by pmcmahon in Tiffany McFarland , out-of-state , out of state , custody rights , Cordell Cordell, PC , contempt , Ask A Lawyer

Question:

My ex wants to take my 3 yr old daughter out of the state for spring break. I want to know if I have any say in this decision because I really don't think I'll ever see her again.

This is a never ending battle with her always trying to change our custody order or wanting to take her out of the state for weeks at a time.  Please, if you can, help.
