Ask a Divorce Lawyer: Can one state suspend or revoke my license if it is from another state due to lack of support payment??

Jason BowmanQuestion: My child support case is in Oklahoma, I live in Texas. 

I recently received a letter about suspending my license for failure to pay child support, even though it is being garnished from my paycheck. 

Can one state suspend or revoke my license if it is a license from another state?

Question: 

I found out about a year ago that I have a daughter that is now 5 years old. I am currently paying child support for her, as well as the back support for the past 4 years. I was never married to her mother. She actually thought this child was someone else’s until the DNA test proved her wrong.

What rights do I have to my daughter as far as visitation goes? She only lets me see her when she is fighting with her now boyfriend who has helped raise my daughter.

Question:My ex-wife and I have Joint custody of our son. She has him one more day a week than I do. In our divorce decree it states that we make all decision making for our son together if we cannot reach an agreement then a mediator will step in and make it for us. In the divorce decree it states that she is primary custodial, please explain to me what this exactly means, she thinks it means that if we cant agree on something together that she ultimately gets to make the final decision making on our son.

Question:

I recently divorced my wife. We have made some attempt to try to make our marriage work, but I am still not convinced that she is willing to change the things that ruined our marriage, or she just want to get back into the house. My question is, if we sleep together after being divorced, will this set our divorce aside?

Answer:

I cannot answer your question specifically to the laws of Oklahoma as I am not licensed to practice law in that State. Generally, no. Once you are divorced, you are divorced. The only thing you can do to change it is if you remarry her.

Ask a Lawyer: What happens with a house during a divorce?

Question:

My wife and I are divorceing and we have owned a house together since 2003. I want to sell the house and split the profits. She wants to stay in the house. She says that she can keep the house and give me half the equity and remain in the house. Then when she goes to sell the house in a couple years she gets to keep all the profits. Is this true? What are our options?

Answer:

Allow me to preface my response that I am not licensed to practice in Oklahoma. She is correct. So long as you receive your portion of the equity that you are currently entitled to, then she can stay in the residence and collect profits down the road. The only real concern is if your name is on the house. She will need to refinance so you can be removed from the debt so you will be able to get a home of your own.
