My sister in law has served my brother with papers for a divorce and he lives in Las Vegas Nevada and she is in Kingman Arizona -will the courts allow joint custody?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Nevada or Arizona. In general the Courts will want to have two parents with joint custody. However there are two types of custody, physical and legal. Physical is the amount of time the parent spends with the child and legal is decision making. He should ask for both rights.

My son turns 18 in March. He was pulled out of public school by his mother about a year and a half ago, and enrolled in a homeschool program located out of Penn. My divorce decree states that I am to pay child support till he is 18, or 19 if still in High School. If he had stayed in school he would have graduated this May. Mom drags her feet, and does not push him to do his homeschool work. She also just made a comment to me the other day that she looked it up and found that homeschool is the same as high scool when it comes to paying child support. I looked around and found nothing stating that, can you help?

Generally there is no difference with respect to what type of schooling the child is enrolled, but rather the fact that he is working toward completion of his high school diploma or GED.

Question:

My fiancee's child support order was arranged in Nevada. He has been paying 18% of his gross income. We just discovered that Nevada has maximum amounts that child support payments cannot exceed without specific reasons being specified. He has been paying well over those maximum amounts for years. For example, right now he pays over $1500/month and the maximum amount is $600. That is a difference of $10,800/year! The support agreement said nothing about maximum limits - it did not specify any, nor did it give any reason why they should not be honored. Has he been overpaying all these years? If so, can anything be done about it? We now live in Michigan and the mother and child live in Wisconsin. If he renegotiates, does he have to do it through Wisonsin, or can he go through Michigan.

Answer:

If there has been a change in circumstances to make the current child support order unreasonable, you should file a Motion to Modify child support.
