Question:

My daughter is in a state college and I am paying one-third of her tuition and off-campus living expenses, in addition to my child support order. She is 20 years old and not progressing academically in this school towards her goal of going to nursing school. So I want her to switch to a community college since she is retaking classes until she gets a better GPA. I'm looking at less debt for her later, but she is refusing to consider it. Since she lives in an apartment, and not with her mother, if I emancipate her at 21, will I still be responsible to pay for her living expenses and college tuition?

Question:

I have the option of taking a lump sum payout from my employer or a monthly pension when I retire. I assume that if I took a monthly pension, child support payments would be based on that payout plan. But if I take a lump sum buyout, what criteria does the court use to determine future child support payments?

I have phone records proving my wife has been having an affair for some time. First, can phone records be brought into a divorce case? And does an affair by the other party make any difference in a divorce in terms of custody or potential alimony payments?

Question:

I am a military dad paying child support and about to go back to school thanks to funds made available by the GI bill from the federal government. Will child support come out of those funds? As part of the GI bill, I will also receive a basic allowance for housing. Can they take child support from that housing allowance?
