Ask a Divorce Lawyer: Why should I pay full child support when I have the kids more than my ex?

Posted by Matt Allen in parenting time , Modification , Jill Best , decree , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question: My three kids are with me every Friday-Sunday and sometimes more. It’s been this way since the divorce four years ago. I pay full child support. Is there a modification available since I have my kids half of the time?

Ask a Divorce Lawyer: Do I have to pay child support for a kid that DNA proves isn't mine?

Posted by Matt Allen in paternity , Jill Best , Infidelity , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question: I have been divorced now for around 2 years. I pay child support and alimony. My child is 11 years old. I just found out today through a DNA test that the child is not mine. My ex-wife has been lying to me all this time. Is there anyway or anything to do so that I don’t have to pay child support any more? This has just TORN me apart and it’s only going to tear me apart even more knowing that my ex-wife is going to be LAUGHING at me all the way to the bank with me paying child support until the age of 18. Is there any JUSTICE for a man in this situation? Can you help me or guide me in the right direction?

Ask a Divorce Lawyer: What exactly does child support legally cover and what does it not?

Question: What exactly does child support legally cover and what does it not (i.e., deductibles, co-payment on necessary medical)? We are finalizing our divorce, and my wife still expects that I am accountable for non-essentials (sports camps, etc.). While I am glad to do as much as I can, I believe the child support should go as far as it can; and after that, it is a matter of either saying "no" to some activities or to getting mutual consent between the two parents on activities and costs. Is this in line with general thinking?

Ask a Divorce Lawyer: What are the best ways to get the parenting plan I desire done quickly?

Posted by Matt Allen in Property , Parenting , Legal Strategy , Jill Best , house payment , Cordell Cordell, PC , Ask A Lawyer

Question: I have been in the process of a divorce for 5+ years (set aside due to a Chapter 13 bankruptcy filing). I am now discharged and trying to get my spouse to sign. We share custody of our son (week on, week off). She has since purchased a house and from my understanding received a very significant settlement ($60,000-90,000) to move. I had presented her a final decree to sign and she has refused. She now says she wants to have the co-parent label removed and wants to be the primary. I have been told previously that I am entitled to a portion of the settlement and since she purchased the house while still married it is considered community property. I just want the divorce finalized and continued shared custody. What, if any, options or leverage might I have?

Ask a Divorce Lawyer: Is child support considered income subject to garnishment?

Posted by Matt Allen in wages , Jill Best , income , garnishment , Cordell Cordell, PC , Child Support , Ask A Lawyer

Question: My daughter owes her lawyer $1,500 in fees and has been paying each month. Her lawyer wants full payment and my daughter presently is not working. Is it possible for the lawyer to garnish the child support she receives? This is her only means of income at the present.
