DadsDivorce Live: Robert Franklin on Paternity Fraud

DadsDivorce Live host Rick Ortiz talks with Robert Franklin, managing editor of FathersandFamilies.org, about paternity fraud and solutions to this growing problem.

Franklin is advocating for mandatory DNA testing at all births to help combat paternity fraud. Using data from the Bureau of Vital Statistics and some assumptions, he estimates in the United States alone between 280,000 to 410,000 children are born to men who think they're the father but aren't.

Franklin has practiced law in Texas for 29 years and is an active fathers' rights advocate whose work can also be found on GlennSacks.com.

What you need to know about paternity fraud

In the wake of his recent passing, radio stations across the world are playing the music of Michael Jackson, commemorating his contributions to pop culture.  The next time you find yourself jamming to his hit Billy Jean, I encourage you to pay close attention to the words which describe the situation that is the nightmare many men live today:  Paternity fraud.   

Paternity fraud occurs when a woman intentionally names a man to be the father of her child when she knows he is not the biological father, often for the purposes of collecting child support.  Celebrities are certainly not the only men who face paternity fraud.  With the advancement and availability of paternity tests, many men are coming to learn that the children they have paid support for over many years are not their biological child.  The devastating revelation leads to many victims, including the non-biological father, the biological father, the families of both men, and most certainly the innocent child.

Question: My husband recently found out that his 3 year-old-son is not his. DNA proved that result. Can he be reimbursed for child support paid since their separation three years ago? Can he have his name removed from the child's birth certificate? Or, if not, is there some kind of legal addendum that can be attached to the birth certificate stating that he is not the child's biological father? Is he due any damages from the mother for her deception?

Question:

I'm paying child support on a child that might not be mine. We were married at the time, split up, and then got back together. It was during our second go around that I found out she was pregnant. How do I go about getting a DNA test arranged to see if the child is truly mine or not?
