Ask A Lawyer: What Rights Does My Husband Have To My 401K When They Were Waived?

Question:

My husband signed a 401K waiver of all rights dismissed, waving all of his rights to my 401k. We are now divorcing and my attorney has informed me that my husband still has rights to my 401k in the event of our divorce or death. The attorney stated that we should have signed the waiver in front of a judge even though it was notarized. My thought on this is if we had known that we would have done it.  Isn’t that the purpose of having 401k laws - to create waiver documents so your spouses can’t get your retirement? My kids are my beneficiaries not my spouse, unless I was to die then all three would get my 401K. Also, how far along back can they check my bank statements?

Question:

I’m in the Army and currently stationed in Iraq. I have joint custody of my son with my ex. However, while I’m here she refuses to let me have any contact with him either by phone or webcam. Is there any rule/law that prohibits her from doing this?

Question:

My wife has filed for divorce and is asking for $4000 a month in alimony. She filed without the use of a lawyer. The amount she is asking for is half of what I make in a month. I am a self employed contractor.

She has five kids from two previous marriages and we have had none together. We have been married for almost five years and pretty much supported them all by my paychecks. She has three businesses that she has started since we moved to California in 2005. She is a realtor, owns a small cosmetics company, and recently started a catering company. What should I be expecting to pay in alimony?
