Ask a Divorce Lawyer: Could my wife get alimony if my income goes up after the divorce is final?

Posted by Matt Allen in settlement , mental , ex parte , drug use , Cordell Cordell, PC , Claudia Weaver , Ask A Lawyer , alimony

Question: Do I have to pay alimony since I have only made $8,000 a year the last 3 years due to a medical reason? Also, my wife made more like $15,000. She just had ex parte; she had an attorney and I didn’t. She wants child support, alimony and fees, and got 50/50 custody.

Does she get alimony if I make a lot more money after the divorce is final? I’m also worried about her mental state, and there’s a police report showing narcotic abuse symptoms. Can I get a mental evaluation for her?

Ask a Divorce Lawyer: Can I gain full custody if my child wants to live with me and his mom threatens him?

Question: I am the primary custodian of my 13-year-old son. He wants to stay with me full time because his mother takes her anger out on him because she's mad at me.

She also threatens him that her stepfather will spank him. Could I get full custody based on his age and the other issues she takes out on him?

Ask a Divorce Lawyer: My wife and I both have restraining orders. What are my options for seeing my kids?

Posted by Matt Allen in restraining order , Cordell Cordell, PC , Claudia Weaver , child order of protection , biological , Ask A Lawyer

Question: My wife and I had a horrible break up. She began seeing another man. After my wife and I had a few very heated arguments, she left with our three children camping for almost a full week with the man in question. The next day (after I took the children to a safe house) my wife and I had another argument. She pushed me into a box of junk cutting my arm, so I restrained her, the police were involved, and we both got restraining orders.

In court her restraining order was extended to a protection order for 1 year, including the children. How do I get contact with at least my one biological child who is 4 years old? I would love to see all three though if possible.

Ask a Divorce Lawyer: Do I have a better chance of modifying my child support now due to the economic environment?

Posted by Matt Allen in unemployment , Modification , Legal Strategy , Cordell Cordell, PC , Claudia Weaver , Child Support , Ask A Lawyer

Question: I was laid off in June 2009 from the paper industry and filed for a modification to child support. The ex is fighting this modification saying I should continue paying the same support based on the $90,000 a year I made. There are no jobs in the paper industry especially at that salary. I applied and started a re-training program in Diagnostic Medical Sonography, which is an 18-month program. She is a speech language pathologist and only earns $30,000 a year. From my research this is significantly less then average. She also takes summers off. Knowing how unfair this system is to men, is it worth the expense to fight this in court?

Ask a Divorce Lawyer: What can I do to change the proposed condition in our divorce?

Posted by Matt Allen in Legal Strategy , gambling , domestic violence , Cordell Cordell, PC , Claudia Weaver , Child Support , Ask A Lawyer , abandonment

Question: What can I do to change the proposed condition in our divorce? She filed for divorce claiming that I have caused our family to break apart because of a gambling issue, our financial problems, and many disagreements. I admitted my mistakes and signed the divorce papers without disagreeing to all her requests. I found out later that she had been gambling constantly and had been meeting someone for a while. How can I change or revise the conditions, such as the $750 child support and especially the custody of my kids? Will it be in my favor if I presented a police report of her attacking and hitting? Can I use her bank statements proving she's been gambling? Is it considered abandonment when she told me and our son she was leaving as she packed her bag and did not come home until the next night? Do I need a lawyer?
