Ask A Lawyer: My Wife Is Emotionally Unstable, Should I Get Custody?

Question:

 

My wife of three years has been unfaithful. She did it once and we moved on, but I just caught her again with another man. I can no longer be with a woman who has cheated, twice now.  We also have a 2 year old daughter who we both love very much.

 

I am currently working on a 60 day contract making good money, but may be out of work after that. If we take our divorce to court, does she have more leverage since she has a solid 9 to 5 job?

 

Emotionally speaking, I feel that she may not be in a good place at the moment.  She is taking anti-depressant and anxiety medications currently.  I don't want to take my little girl away from her, but I am not comfortable with her state of mind right now. She is a great mother, but I worry about what may happen if I am not there.  I wonder how she will handle being away from a child she loves with all her heart. What do I do now, and do I have any chance for obtaining custody of my child with my job being so up in the air?

I have been married for eleven years, and for three of those years I have wanted a divorce. During the marriage, my wife had an affair and got pregnant. For nine years after that, I thought the child was mine but a DNA test proved differently.

Can I sue for parental fraud?

Question:

I found emails and pictures (non-explicit) that my wife sent to another man. All of them said I love you, or you have my heart and soul. I also have cell phone logs of her talking to this man all day while I was at work. She owns a home business that is fully financed by my job. I also found an explicit picture he sent her.

Although I can't actually prove she has slept with him, does infidelity affect how much alimony I will have to pay her in the state of Georgia?

Question:

I found out last Friday my wife has been having an affair for some time. We have a 5 month old son. She has just signed a lease to move in with the man she has been seeing. Is this legal?

She is defying a court order to stay in our condominium with our 5 month old son by staying at the boyfriend's house.
