The argument that the solution when dealing with two fit parents is that the court should begin by treating both parents as equal in custody litigation only validates the court's intervention. A better approach I believe is that issues of custody and access for fit parents should be beyond the scope of the court. These issues must be treated not as a matter of law but as a family crisis requiring a completetely different venue---- such as ADR (alternative dispute resolution).
