Ask A Divorce Lawyer: Do grandparents have any rights to see their grandchildren following a divorce?

Posted by pmcmahon in Visitation , Steven Lee Akins Jr. , Parenting , grandparents , grandparent visitation , Cordell Cordell, PC , Ask A Lawyer

Question:

My son has two children with his ex-girlfriend, and they have been separated for more than 3 years. My son technically has joint custody of the kids, but he never sees them. His ex-girlfriend bars me from seeing my grandkids when I visit the city they live in; I travel there every year to see my family who also lives in the area. She has told the kids that I’m dead and that’s why they don’t see me. Is there anything I can do legally about this? Do grandparents have any rights to see their grandchildren following a divorce?

Ask A Divorce Lawyer: If I emancipate my daughter, am I still responsible for her college expenses?

Posted by pmcmahon in Steven Lee Akins Jr. , Maintenance , emancipation , Cordell Cordell, PC , college expenses , Child Support , Ask A Lawyer

Question:

My daughter is in a state college and I am paying one-third of her tuition and off-campus living expenses, in addition to my child support order. She is 20 years old and not progressing academically in this school towards her goal of going to nursing school. So I want her to switch to a community college since she is retaking classes until she gets a better GPA. I'm looking at less debt for her later, but she is refusing to consider it. Since she lives in an apartment, and not with her mother, if I emancipate her at 21, will I still be responsible to pay for her living expenses and college tuition?

Ask A Divorce Lawyer: Do child support calculations take into account monthly pensions?

Posted by pmcmahon in Steven Lee Akins Jr. , pension , Maintenance , Cordell Cordell, PC , child support payment calculations , Child Support , Ask A Lawyer

Question:

I have the option of taking a lump sum payout from my employer or a monthly pension when I retire. I assume that if I took a monthly pension, child support payments would be based on that payout plan. But if I take a lump sum buyout, what criteria does the court use to determine future child support payments?
