Ask A Divorce Lawyer: Problems With Temporary Custody Prior To Divorce

Posted by Rick Ortiz in temporary orders , Richard Coffee , PAS , Parental Alienation Syndrome , Cordell Cordell, PC , child custody , Ask A Lawyer

Question: My brother has filed for divorce without using an attorney. His soon to be ex-wife will not allow him to have their daughter every other weekend like was customary. What should he do to ensure that he be allowed to see his daughter regularly until divorce is final, and how should he document his soon-to-be-ex's resistance to allowing him time with his daughter? Also, any advice as to how to make hand-off times go smoothly and protect himself against her rage and possible threats to make false allegations?

A Mans Mind: Divorce Tips To Claim, Focus and Engage By Living a Healthy Life

Three of the deepest human necessities are the need to belong, to be needed, and be involved with family, work and community.  It is important to remain healthy during divorce and afterwords.

The need to belong and engaged is so great that people who aren’t actively engaged in all facets of life tend to be poor performers, disengaged, lack motivation and simply exist one-dimensionally.

In some cases being detached and inactive can lead to bouts of down-heartedness, depression and higher rates of chronic illnesses.  Read more to find out what you should be doing to stay in the game.

Ask A Divorce Lawyer: Divorce On A Budget

Posted by Rick Ortiz in Richard Coffee , Cordell Cordell, PC , Ask A Lawyer

Question: I am typing this after my wife just called me and told me she is filing for divorce. She cheated on me earlier this year. I am trying to forgive her and work on our marriage. She told me she wants a dissolution of marriage and she wants to move our kids from Ohio to Missouri, 8 hours away. She basically wants me to give up my rights to my kids. She said I will have no choice in anything because I am collecting unemployment right now. How can a guy in a tough financial situation begin to fight having his kids taken away from him?

Ask A Divorce Lawyer: Dealing With Her New Boyfriend In My Life

Posted by Rick Ortiz in Richard Coffee , Cordell Cordell, PC , Ask A Lawyer

Question: My ex wife has primary physical custody of my 2 children ages 10 and 6 , she states that I have no choice but to deal with the boyfriend dropping off and picking up my kids from my house. I do not agree with this. Do you have any advice as to how I can handle the uncomfortable situation of the new boyfriend further injecting himself into my life and my children's lives?

Ask A Divorce Lawyer: She Wants Out

Posted by Rick Ortiz in Richard Coffee , Cordell Cordell, PC

Question: I just found out my wife wants a divorce after almost 5 years of marriage and nearly 10 years together. We have a 2 1/2 year old son. She claims she started falling out of love me since the day before she found out she was pregnant. I saw no signs of unhappiness in this marriage and this is a shock to not only me but to my parents, her parents, and all of our friends. She has told me that she wants nothing from me, no child support, she wants 50/50 custody, and that she will give me what I have invested in the house and property we own.

She states that she just "wants me to let her go." I am curious about what I should do. This is such a shock to me and now I have to find a way to start my life over at 35 years old with no plan in place.  What do I need to do to go about this in the most effective way? I'm sure you hear this story fairly often, do you have any advice for what I should watch out for?
