Ask a Lawyer: Attorney in Texas

Question:

I have been out of the house for 3 months. I signed temp orders so I could see my kids. My wife refuses to let me have my belongings and access to personal finance files. She filed and we lived together for 7 months before I found out. My attorney states that we have to wait until it is final to get my things. Is this the way it is in Texas? What happens if I change lawyers?

Answer:

I am not licensed in Texas. I doubt changing lawyers will change the law. You may seek an order allowing you to remove personal belongings but a final distribution of property is determined at final hearing.

Question:

Can a judge set the alimony & child support payments to be in excess of my salary? I am gainfully employed, with a good job, but I don't make this much money. What can I do?

Answer:

I am not licensed in Alabama. I recommend you consult an attorney in your state. Normally there is a cap on support of 50-60% of your income. Did your income recently decrease? It is possible your support was based on your past income or the income the court believes you should be making.

Question:

My new husband has 3 children with his ex wife. The divorce papers state we get the children every other weekend when he is in from work. One of his children will not come and has not come to our house in 9 weeks. His son said we do not spend enough money on him so he won't come and he wants his step father to adopt him. If he will not come do we still have to pay child support for him? If the child wants his step father to adopt him and my husband agrees to it do we still have to pay child support on him?

Answer:

Every state will have varying laws and I am not licensed in Louisiana. However, child support is not contingent upon visitation. Regardless of whether you husband exercises his visitation he is still obligated to pay support. A child should never be allowed to decide if and when he visits. If your husband agrees to an adoption, his parental rights will be terminated. It is important to realize that you cannot modify an adoption. He will no longer be the father of his son. Along with his parental rights his obligation to pay support will also terminate.

I have received temporary custody of my daughter due to her mother having a motor vehicle accident. How can I make sure I get and keep full custody. My ex-wife has put my family and my other children through hell for two years with false allegations and we were due to go back to court this week but due to the accident I was granted temporary custody and the judge after taking to all lawyers and counselors involved through all the restrictions out the window. What does this mean for us and how can we make sure this doesn

Ask a Lawyer: Mother Does Not Want To Work

My friend and his wife have split up - they have two children, both under the age of 10. My friend's wife does not have a job and has never been able to last more than two months at a job. She was evicted from her apartment because she couldn't pay the rent so she moved in with a relative. She has been telling everyone that she has no plans of getting a job because she was going to get her husband to pay for rent, her car (which has not yet been repossessed probably because her mother is giving her money to pay for it), and everything else. I know California is a no fault state but my friend is leaving her because she has been unfaithful very many times throughout their union. She doesn't have money to spend on her kids yet she smokes, drinks and has had numerous tattoos and piercing done since my friend left her. Will he have to pay alimony? I know he has to pay child support but can't the court make them share the expenses of their children - especially since she gets free day care from her mother, who doesn't work either. Please advise. Thanks.

Answer:

Every state will have varied laws regarding spousal and child support. Since I am not licensed in California it is important to also consult an attorney who is. As you know, your friend will be obligated to pay support for his children. The amount will depend on the custody arrangement. Wife's income may be a factor if California uses an income share model to calculate support. If this is the case, then income can be imputed to her based on what she should be making not what she is actually making. States vary greatly on the award of alimony. The court may factor in her ability to work and earning potential in determining the amount of spousal alimony.
